Agreement, terms and conditions for rental of information
Between: The Exhibitor as set forth in the “Company (Legal Name)” field of the order form hereto (“the Exhibitor”)
And: EMATTER TECHNOLOGIES PTY LTD trading as Lüp Events (“the Company”)
In consideration of the Exhibitor paying the sum set forth in the field on the order form hereto, the Company agrees to rent to the Exhibitor as follows:
Such electronic information, collected by the Company at the Event, as set forth in the schedule, relating to any requests or competitions entered into by any person with the Exhibitor only for the period set forth in Item 2 of the attached Schedule, and will be provided to the Exhibitor in electronic format in the form of a CSV or Excel file.
The Exhibitor agrees with the Company as to the following terms and conditions of use of such electronic information:
The Exhibitor allows and authorises the Company to install in the Exhibitor’s site at the Event, such electronic equipment as the Company may consider necessary for the purposes of collection of data from attendees at the Event.
The Exhibitor will be responsible for the security and safety of the electronic equipment so installed and any loss or damage to such equipment shall be paid for by the Exhibitor within seven [7] days upon receipt of an invoice from the Company for the repair or replacement Recommended Retail cost of such equipment.
The information can be used for the number of times as provided for in Item 1 of the attached Schedule during the period provided for in Item 2 of the attached Schedule, by way of any one of the following forms of communication namely surface mail, email, telephone communication or any other form of communication with the person - That the Company and its suppliers are not able to, nor does it guarantee the accuracy of the information provided to the Exhibitor and is not liable for any inaccuracies therein.
That the Company and its suppliers are not liable or responsible for any damages arising from the Exhibitor’s use of the electronic information provided by the Company or of the inability of the Exhibitor to use the electronic information for any reason.
The Exhibitor agrees that the information being purchased may only be used on a reasonable frequency, per individual entrant, per month. - That if the exhibitor breaches the reasonable frequency per month provision, that it shall pay to the Company the sum of $1,000.00 for each breach of that provision as liquidated
That the Exhibitor indemnifies and shall keep indemnified the Company and its suppliers from all claims suites actions or demands that may arise from the Exhibitor’s use of the electronic information. - The Exhibitor must, if requested in writing by the Company and its suppliers, remove any electronic information relating to a person, as directed by the Company, from their records.
The Exhibitor will use the electronic information in a manner that is consistent with all applicable laws of Australia.
The Exhibitor is responsible for ensuring any competitions are consistent with all applicable laws of Australia.
General:
“breach” means a breach of the duty relating to each piece of electronic information.
SCHEDULE
Event: The Business Show 2025
Item 1: Number of uses authorised: Unlimited use (with a reasonable frequency per month)
Item 2: Period: From 1st January 2022 to: No end date
Item 3: Information to be provided to Exhibitor: QR Code, First Name, Last Name, Email, Phone Number, Post Code, and selected survey information.
